Significance of Family Violence in Property Settlement | Family Law Education Network of Australia

The law has struggled to keep up with society’s changed attitudes towards and perceptions of family violence and its impact on families.

The criminal system is largely State based and there is a disconnect between Commonwealth and State laws and their application and enforcement.

The civil system permits of property settlement proceedings, usually upon the breakdown of a relationship, under the Commonwealth Family Law Act. What role does family violence play in such proceedings, and what are the options for an aggrieved party? This presentation will consider ‘Kennon’ claims, as well as the jurisdiction of the State courts to hear claims based on intentional torts such as assault, trespass to person, battery and false imprisonment.
